POSITION SUMMARY:

The Senior Employee Relations Specialist will partner with the HR Manager in leading the development and administration of the employee relations (ER) program and employee advocacy. This position will be the lead interface with employees, government agencies on all ER matters. The Senior Employee Relations will drive employee relations initiatives within TCC’S field and corporate operations across all locations nationwide by providing direction on ER related business matters as pertains to EEO claims, unemployment programs, background checks, safety and worker’s compensation, design and interpretation of HR policy and procedures, design and maintenance of field and corporate policies and procedures, independently investigate complex employee relations matters and apply sound judgement in driving termination decisions. This position will partner closely with store management, HR leadership and Senior corporate leadership as a subject matter expert in the development on an ER center of excellence.

 

ESSENTIAL FUNCTIIONS:

  • Independently lead and direct complex relations inquiries through the full investigations process from case receipt to closure with a high level of customer focus, confidentiality and sensitivity. This position supports the entire organization in all matters related to complex ER investigation needs.
  • Independently plan, conduct, organize, lead complex investigations, present conclusions and utilize high level of judgement to make recommendations for appropriate post investigation actions concerning, but not limited to, harassment, discrimination, retaliation, and reasonable suspicion. Partner with corporate and field leaders to follow through on post investigations recommendations.
  • Write timely, thorough investigation reports for submission to Sr HR leadership and update case reports with details/results of the investigation.
  • Capture information in case management system and provide analytic data to Sr HR leadership for decision making.
  • Analyze data to proactively identify trends and patterns and report findings appropriately.
  • Create and distribute analytical reports to Employee Relations Stakeholders.
  • Ability to create and present ER training material to Field and corporate leaders. Ensure training materials are routinely updated to reflect any changes in the law or in company policies or procedures.
  • Provides sound coaching and recommendations to issues that affect employment status, affirmative action, and diversity.
  • Proactively identifies issues and concerns and creates/implements corrective plans of action.
  • Provides balanced insights and recommendations in work-related employee conflicts.
  • Works with Legal Counsel in obtaining and presenting information for litigated claims.
  • Ensure compliance with all legal requirements and government reporting regulations related to the employment of team members including OSHA, EEO, ERISA, FLSA guidelines, harassment, and discrimination.
  • Prepares documents and represents company at wage claim hearings.
  • Any other duties as assigned.

SKILLS:

  • Subject-matter-expert knowledge and proven prior experience in labor law interpretation and compliance matters, to include but not limited to interpreting current federal and state laws pertaining to HR policies and procedures, employment and harassment prevention programs, labor, wage, and hour laws, including EEOC, AA, ADA, FLSA, etc.
  • Excellent organizational skills required; ability to effectively multi-task and prioritize.
  • Proven prior experience and ability to independently manage a large case load of complex investigations from beginning to end with minimal direction.
  • Ability to maintain high level of confidentiality and integrity while executing responsibilities.
  • Establish trust and credibility with team members at all levels in the organization, utilizing a customer-service orientation when interacting with teammates to ensure they feel respected and supported.
  • Action oriented and adaptability to a fast-paced changing environment.
  • Proactive in identifying internal customer needs and recommend solutions.
  • Ability to draw sound conclusions and make responsible recommendations.
  • Experience resolving complex employee relations’ issues.
  • Operate with integrity and fairness.
  • Proficient in Microsoft Office Suite (Word, Excel, PowerPoint) and in using case management system.
  • Excellent verbal and written communications.

 

 

EDUCATION & EXPERIENCE:

  • Bachelor’s degree in Business Administration or Human Resources or equivalent work experience in Human Resources as an HR Manager or HRBP.
  • Five years of experience in a position of responsibility within Employee Relations including experience independently driving complex ER investigations in a fast-paced environment, multi-location; retail environment preferred.
  • SHRM Senior Certified Professional (SHRM-SCP), SHRM Certified Professional (SHRM-CP) credential or Master’s degree preferred.
  • HRIS experience is a plus.
